Abstract
This Act consisting of 34 sections aims to amend the original text of 2010 to enhance competition, protect consumers, and align with regional regulations as follows (i) adding new definitions for terms like “resale price maintenance,” “statutory monopoly,” “COMESA,” and “unconscionable”; (ii) updating definitions for “Zambia Bureau of Standards” and “Zambia Compulsory Standards Agency”; (iii) extending COMESA Competition Regulations to all economic activities affecting Zambia and its member states; (iv) including the new section 5A detailing the functions of the Board of Commissioners, including overseeing the Commission’s policies, approving budgets, and delegating functions to the Executive Director; (v) prohibits enterprises and trade associations from entering agreements or practices that prevent, restrict, or distort competition that could harm the market and consumers; (vi) mandating Commission approval for relocating core assets outside Zambia; (vii) strengthening consumer protections against unfair trading practices, false representations, coercion, and the sale of substandard or expired goods. The third schedule of the COMESA Competition Regulations is outlined in the Appendix.
