Abstract
These Regulations, comprising 40 articles, aim to ensure a structured and transparent licensing framework that promotes accountability and compliance within the energy sector in Zambia. Specifically, they set out the rules for establishing or operating an enterprise. Applications must be submitted to the Director General using Form I, along with the required fee. The Energy Regulation Board (ERB) assesses applications based on specific criteria and may request additional information or conduct a site visit before issuing a provisional or full license. Licenses must be prominently displayed on business premises and renewed prior to expiration. The ERB has the authority to modify, suspend, revoke, or approve the transfer of licenses, with all decisions formally communicated through designated forms. The Regulations also detail permit requirements and procedures. Part IV specifically governs the transport of petroleum products via pipeline, prohibiting licensees from contracting with third parties who lack an import license. Non-compliance may result in fines. If a contract is made with a licensed third party, the licensee must notify the ERB and adhere to principles such as non-discrimination, fairness, and confidentiality. Additionally, pipeline usage guidelines must be submitted and updated with the ERB.
The final section of the Regulations covers general provisions, including excluded activities, handling lost or destroyed licenses or permits, maintaining a register of licenses and permits, record-keeping, penalties, and fees.
