Abstract
These Regulations implement provisions of the Mines and Minerals Act by regulating a variety of matters related to mining operations and collateral operations such as the removal of timber from prospecting or mining sites and the felling of trees standing on such sites. Other matters include inspection of mining works and preservation of mining rights, payments to landowners in terms of section 188 of the Act, marking of premises and the protection of workers.
Part I regulates the taking of indigenous wood or timber, for which a tariff has been prescribed in Schedule 3, by a prospector, miner of concession holder. It shall not apply to indigenous wood or timber taken under an agreement in terms of subsection (4) of section 103 or subsection (2) of section 178 of the Act. No timber shall be removed unless it is stacked. The prospector, miner or concession holder shall keep records of wood or timber taken. The Mining Timber Permit Board or the owner or occupier of any land shall have the right to inspect the records and to measure any indigenous wood or timber stacked or collected. Regulation 12 places restrictions on the felling of trees.
