Abstract
This Regulation approves special requirements for the issuance of types A, B, and C environmental permits, the permits transfer, and the detailed rules of procedure for permit application examination and issuance by the National Licensing Center. The Regulation sets forth special requirements for the issuance of types A, B, and C environmental permits, the permits transfer, and the detailed rules of procedure for permit application examination and issuance by the National Licensing Center. It is composed of the following chapters: I – General Provisions, II- Requirements and Rules of Procedure for Type A Permit Application, III- Requirements and Rules of Procedure for Type B Permit Application, IV- Requirements and Rules of Procedure for Type C Permit Application, V- Functional Changes in the Type A and Type B Installations and Revision of the Existing Permits Terms and Conditions, VI- Public Participation and Information about Environmental Permits Applications, VII- Transfer of Type A, B, and C Environmental Permits, and VIII- Final Provisions. Regarding governance the Ministry of Environment, the National Environmental Agency, the local government units, and the National Licensing Center are responsible for enforcement. The National Environmental Agency is also responsible for establishing and administering the registry of type A and B permits. Further, templates/forms of type A, B, and C permits applications, as well as acts of refusals and approvals are attached to the regulation. The information contained in the application includes general data on the applicant; information on the installation; land ownership; material management including waste management; discharges in air, surface waters, and land; non-ionizing radiation; agricultural and non-agricultural waste; land and water pollution; noise impact assessment; discharge reduction and control systems; monitoring including monitoring of environmental quality; environmental best practices; improvement plans; other preventing measures; rehabilitation and operations’ suspension, reopening and inspection; waste management plans; non-technical summary; and applicant declaration on the accuracy and thoroughness of submitted information. This regulation is partially approximated with the EU Directive 2010/75/EU “The Industrial Emissions Directive”.
