Abstract
The Austrian Market Organization Act 2021 (MOG 2021), establishes the legal framework for the implementation, administration and control of the EU Common Agricultural Policy (CAP) in Austria. The Act defines the objectives, scope and institutional responsibilities for the organisation of agricultural markets, designates Agrarmarkt Austria as the competent paying and intervention agency, and sets out rules for direct payments, sectoral support (e.g. for fruit, wine and beekeeping) and rural development measures under the CAP Strategic Plan. It further provides detailed provisions on conditionality, monitoring, control systems, data management, sanctions and administrative procedures, while empowering the competent ministry to adopt implementing regulations in line with EU market organisation law and CAP financing and governance rules.
The continued amendments on the law, evolved it into the current framework law for implementing the EU Common Agricultural Policy in Austria. Amendments in 2018 and 2019 refined administrative procedures, control systems and financing rules in line with updated EU requirements. The reform in 2022 revised the Act, including its structure and terminology, and formally retitled it as “Marktordnungsgesetz 2021” to align with the CAP 2023–2027 framework.
