Abstract
The Act gives effect to the Convention to the Antarctic Treaty and the Protocol on the Environment to the Antarctic Treaty and makes other provision relating to the protection of the environment and wildlife in the Antarctic.
The text of the Act consists of 57 sections divided into 6 Parts: Preliminary (1); Conservation of Antarctic fauna and flora (2); Environmental impact assessment (3); Inspectors (4); Offences (5); Miscellaneous (6).
Section 7 outlines the relationship of this Act with other Acts of the Commonwealth. Subject to section 8, the Governor-General may: (a) by Proclamation, declare an area specified in the Proclamation to be an Antarctic specially protected area; and (b) by the same or by another Proclamation, declare an area specified in the Proclamation to be an Antarctic specially managed area. Activities specified in section 19 require a permit from the responsible minister (sect. 9). Part 3 provides for the assessment of proposed activities in the Antarctic to identify the likely impact on the environment and regulates activities that are likely to have an adverse impact on the environment.
The Act is completed by 3 Schedules: Convention for the Conservation of Antarctic Seals (1); Report on 1988 meeting of representatives of contracting parties to the Convention (2); Protocol on Environmental Protection to the Antarctic Treaty.
Chapter 2 of the Criminal Code applies to all offences against this Act (sect. 6A).
