Abstract
The Regulations provide for the discipline of water supply and competition. Part 1 prescribes additional classes, of water industry infrastructure for the purpose of section 3A(f) of the Water Industry Competition Act 2006: (a) the supply of drinking water, (b) the collection and treatment of groundwater for the production, supply and use of water, (c) the collection and treatment of wastewater, other than sewage, stormwater or recycled water, for the production, supply and use of water. The Part continues identifying water industry infrastructures to which Part 2 of the Act applies and does not apply. Division 2 concerns scheme approvals and operational approvals. Division 3 Licences.
Part 3 Operation of water retail market; the terms and conditions of the deemed customer contract are set out in Schedule 4. Part 4 regulates investigations into pricing determinations for monopoly services—the Act, s 52(3) and (4). Part 6 regulates the connection of a development to an infrastructure. Part 7 provides for application audits and compliance audits.
