Abstract
These Rules are framed pursuant to the powers under section 20 of Bangladesh Environment Conservation Act, 1995. These Rules aim to ensure sustainable development and prevent environmental degradation in Bangladesh by regulating the activities that may have adverse impacts on the environment and human health.
Rule 3 provides for application by any person who has suffered loss due to environmental pollution and the same shall be disposed of within 30 working days. Rule 4 provides for the format of Notice to an owner, occupier or agent for collection of samples of air, water, soil or other substances. Rule 5 requires industrial projects and units to be classified based on their activities, pollution, and potential harm to the environment and health into Green, Yellow, Orange and Red categories. The Rules further lay down the procedure to obtain environmental clearance and location clearance certificate and the validity thereof.
The Rules lay down the criteria and guidelines for conducting EIA and preparing environmental management plan. It also contains provisions for appeals, the appointment of appellate authority and the procedure to be followed by such authority. Rules 31 and 32 provide environmental standards for water quality, liquid waste emission etc. Rule 33 pertains to construction, approval and operation of liquid/sewage waste treatment plants of industrial establishments and projects. The Rules also provide for fees in respect of the services provided and mode of payment for the same.
