Abstract
This Act lays down provisions on the establishment and functions of the Public Procurement Department; appointment and functions of the Chief Procurement Officer; funds, revenue and resources of the Department; establishment, duties and powers of the Public Procurement Board; functions of procuring entities and units; functions and powers of tender committees; procurement planning and methods; establishment of Procurement Review Tribunal; procedures for complaints; appeal to the Tribunal; debartment procedures; recording of the procurement and the management of the procurement contract; and offences and penalties.
Subject to subsections (3) and (4) regarding national security or defence, this Act shall apply to all procurement carried out by a procuring entity. The Public Procurement Department is responsible for developing sustainable procurement practices and guidance to reduce the adverse environmental and social impact through better selection and improved usage of purchased goods and services, and encouraging suppliers to adopt practices that minimize their adverse environmental and social impacts in relation to their own operations and supply chains. The Financial Secretary may debar a bidder if that bidder is convicted or has a civil judgement against them for commission of fraud or bribery or any relevant criminal offence.
