Ministerial Decree No. 698 validating the Regulation on capture of wild fauna for captive breeding, release, introduction, re-introduction, acclimatization and cross-breeding.

This Ministerial Decree shall not be applicable to endangered species recorded in the Red Book. Capture of wild fauna shall be carried out by legal persons and individual entrepreneurs in accordance with permits issued by the Ministry of Natural Resources and Environmental Protection. An application for capture of wild fauna shall be submitted to the Ministry a month before the projected date of capture. Application must obtain prior consent in the following cases: (a) if capture shall be carried out in the fishing areas or hunting grounds allotted on lease (with lessee); (b) if capture shall be carried out in reserve fishing area and hunting grounds (with local self-government); (c) if capture shall be carried out on protected areas (with the authorized environmental institution); and (d) if capture shall be carried out on radioactively polluted areas (with the Ministry on Emergency Situations). The application shall contain: (a) copy of constituent documents and registration certificate; (b) copies of biological substantiation for stock enhancement of fishing areas, repopulation of hunting grounds with wild fauna species and other documentation. In the process of capture shall be preserved migration routes, natural habitats and mating and spawning grounds. The following capture methods shall be prohibited: (a) female mammals in late pregnancy; (b) wild animals with cubs unfit for autonomous living; (c) birds during nesting period and prohibited seasons; (d) wildlife species in the protected areas and by prohibited methods.
