Resolution No. 2 of the Ministry of Forestry amending Resolution No. 56 of the Ministry of Forestry validating the Regulation on inspection of public forest for compliance with terms and conditions indicated in the documents certifying forest management rights and performance of forest management arrangements.

Instruction on the procedure for inspecting forest fund land plots for compliance with the conditions specified in the documents on the basis of which the right to use natural resources and carry out forestry activities arises establishes requirements for the organization and conduct of inspection of forest fund land plots by officials who are assigned the functions of state forest protection, for compliance with the conditions specified in the documents on the basis of which arises the right to use natural resources and conduct forestry activities. Based on the results of the inspection, officials who are entrusted with the functions of state forest protection draw up an inspection report in the form in accordance with Appendix 1. In the event that, during the inspection, facts of violation of the conditions specified in the documents on the basis of which the right to use natural resources arises, and the implementation of forestry activities are established, the officials who are entrusted with the functions of state forest protection, take the following measures: (a) issue mandatory orders to eliminate the identified violations of the legislation on the use, protection, conservation and reproduction of forests, on environmental protection in the form according to Appendix 2; (b) draw up protocols on administrative offenses, issue decrees on cases of administrative offenses, carry out preparation and consideration of cases of administrative offenses against ecological safety, the environment and the procedure for the use of natural resources in accordance with the procedural and executive legislation on administrative offenses; and (c) seize illegally harvested forest products from citizens, legal entities, individual entrepreneurs.
