Abstract
This Regulation deals with both contracts and subcontracts in timber harvesting. It is divided into 7 parts as follows: Part 1 - Interpretation and Application; Part 2 - Written Contracts and Subcontracts Required; Part 3 - Assignability of Contracts and Subcontracts; Part 4 - Dispute Resolution; (Division 1 - Dispute Resolution Requirements; Division 2 - Dispute Resolution System; Division 3 - Register of Arbitration Awards); Part 5 - Replaceability of Contracts and Subcontracts; (Division 1 - Contracts; Division 2 - Amount of work; Division 3 - Amount of Work Disputes; Division 4 - Rate Disputes; Division 5 - AAC Reductions; Division 6 - Subcontracts); Part 6 - Contractor Clause Compliance; Part 7 - Required Provisions and Schedules 1 to 20. Part 4 outlines the practices, procedures, fees and expenses of mediation and arbitration. Part 5 specifies that a replaceable contract must provide for the contractor to continue to satisfactorily perform its obligations under the contract as a condition. This Regulation deals with amount of work and rate disputes arising in the absence of express provision. Part 5 also deals with the reduction of "AAC" (allowable annual cut) and dispute resolution proceedings. Part 6 provides that compliance of "contractor clause" by the holder of a licence must be assessed for each calendar year in accordance with this Regulation. Finally a contract or subcontract must contain either the standard provisions contained in the schedules, which comply the requirements specified throughout this Regulation, or similar provisions agreed to by the parties
