Abstract
This Decision of the Standing Committee of the National People's Congress is made to amend eight laws including the Road Traffic Safety Law, the Fire Protection Law, the Law on Import and Export Commodity Inspection, the Advertising Law, the Grassland Law, the Civil Aviation Law, the Customs Law and the Food Safety Law.
The Road Traffic Safety Law of the People's Republic of China is amended. Paragraph 1 of Article 20 is amended to read: The motor vehicle driving training shall be provided by non-government institutions. The transport department shall subject driving training schools and driving training classes to recordation administration, and strengthen the supervision of driving training activities. In particular, special tractor driving training schools and driving training classes shall be subject to the supervision and administration of the agriculture (agricultural machinery) department.
The amendments to the Food Safety Law of the People's Republic of China include: the first paragraph of Article 35 is amended to read: "The state implements a licensing system for food production and operation. To engage in food production, food sales, and catering services, licenses shall be obtained in accordance with the law. However, for those who sell edible agricultural products and only sell pre-packaged food, there is no need to obtain a license. Those who only sell pre-packaged food should report to the competent food safety supervision and management authority of the local people's government at or above the county level for the record."
Article 52 of Grassland Law is amended to read: "The development of commercial tourism activities on grasslands shall conform to the relevant plans for grassland protection, construction, and utilization, and shall not infringe upon the lawful rights and interests of grassland owners, users, and contractors. Grassland vegetation must not be damaged."
Amendments to the Law of the People's Republic of China on Import and Export Commodity Inspection include: (1) in Article 3, "inspection institutions approved by the State Commodity Inspection Department" are replaced with "inspection institutions established according to law"; (2) Delete Article 22; etc.
