Provisions on the procedures of administrative punishment for tobacco monopoly (2023).

These Provisions are formulated in accordance with the Law on Tobacco Monopoly and the Regulations on implementation of the Law on Tobacco Monopoly, aiming at regulating the administrative punishment acts, safeguarding the national tobacco monopoly system, and defending the lawful rights and interests of the entities and individuals. The Provisions consist of 93 Articles divided into 10 Chapters: General provisions; Jurisdiction; General requirements; Simplified procedures; Ordinary procedures; Hearing procedures; Enforcement; Supervision; Legal Liabilities; Supplementary provisions.
According to the Law on Tobacco Monopoly and Regulations on implementation of the Law on Tobacco Monopoly, a unified purchase of leaf tobacco shall be effected by tobacco companies or their authorized agencies in accordance with the standards and prices set by the State; Without approval, no unit or individual shall purchase tobacco leaves; Those who purchase tobacco leaves without authorization may be fined not less than 20% but not more than 50% of the value of the illegally purchased tobacco leaves, and the illegally purchased tobacco leaves shall be purchased at the price set by the state.
Where the executing authority of the tobacco monopoly needs to mete out administrative punishments according to law, the Provisions shall apply. When imposing administrative punishments, the executing authorities of the tobacco monopoly shall follow the principles of fairness, impartiality, openness, transparency, ensuring the legitimate rights and interests of the parties involved.
