Regulations on implementation of the Law of the People's Republic of China on Tobacco Monopoly (2016).

These Measures are formulated for purposes of exercising tobacco monopoly administration, organizing the production and management of tobacco monopoly commodities in a planned way, improving the quality of tobacco products, safeguarding consumers' interests and ensuring the national revenue. the Text consists of 8 Chapters: General Provisions (I); Tobacco Monopoly Licenses (II); Plantation, Purchase and Appropriation of Leaf Tobacco (III); Production of Tobacco Products (IV); Sales of Tobacco Products (V); Transportation of Tobacco Products (VI); Production and Sale of Cigarette Paper, Filter Rods, Cigarette Tow and Special Tobacco Machines (VII); Import and Export Trade and Foreign Economic and Technological Cooperation (VIII); Supervision and Inspection (IX); Legal Liability (X); Supplementary Provisions (XI).
The State shall exercise monopoly administration over the production, sale, import and export of tobacco monopoly commodities, and adopt a tobacco monopoly license system. In order to engage in the production, wholesale and retail, import and export of tobacco monopoly commodities, and the business and operations of the purchase and sale of foreign tobacco products, a tobacco monopoly license must be obtained. Tobacco monopoly licenses are divided into: (1) Tobacco Monopoly Production Enterprise License; (2) Tobacco Monopoly Wholesale Enterprise License; (3) Tobacco Monopoly Retail Sale Enterprise License. The State Tobacco Monopoly Administration, together with the relevant provinces, autonomous regions and municipalities, shall work out leaf tobacco planting plan.
Tobacco leaves should be purchased in a unified way by tobacco companies or their entrusted units. Tobacco companies or their entrusted units may, according to needs, open tobacco purchasing stations (points) to purchase tobacco in areas that have received plans for purchasing tobacco issued by the State. Plans for State reserves, exports and appropriation of tobacco leaves shall be issued by the planning department of the State Council. Producers of tobacco products should strictly operate according to the production plan issued by the State.
