Abstract
These Regulations aim to support and guide the development of specialized farmers’ cooperatives, regulate the norms and behaviour of such organizations, protect the legitimate rights and interests of farmers' cooperatives and their members, and promote agricultural and rural economic development. This Law consists of 6 Chapters divided into 53 articles: General Provisions (I); Establishment and Registration (II); Membership, Organizational Structure and Financial Management (III); Guidance Services and Support Measures (IV); Legal Liability (V); Supplementary Provisions (VI).
The Text provides for: legal capacity and powers of cooperatives; members of cooperatives and their rights and liabilities; cooperatives’ rules; operations of cooperatives; management and administration of cooperatives; cooperatives’ funds and property; the unification or division of cooperatives; policy support including preferential tax policies; offences and penalties; etc.
For establishment of a specialized farmers’ cooperative, an application for establishment registration shall be made to the competent authority (atr.8).
According to Article 14, farmers may join the farmers’ cooperatives in different places, without geographical restrictions; farmers may also join multiple farmers’ cooperatives.
