Abstract
The purpose of these Regulations is to prevent and control atmospheric pollution, improve the quality of atmospheric environment, safeguard human health, promote ecological civilization construction, and promote the sustainable development of economy and society. The Regulations consist of 108 Articles divided into 8 Chapters: General provisions (I); Supervision and administration on prevention and control of air pollution (II); Prevention and control of pollution caused by energy consumption(III); Prevention and control of pollution caused by emission from motorized vehicles and vessels (IV); Prevention and control of pollution caused by exhausts, dusts and odors(VI); Yangtze River Delta regional cooperation on prevention and control of air pollution (VI); Legal liabilities (VII); Supplementary provisions (VIII).
The municipal environmental protection authority shall organize the preparation of atmospheric pollution prevention and control plan. The Municipal People's Government shall adopt strict measures to ensure the atmospheric environmental quality in compliance with the standards set by the state within the prescribed time limit.
Total emission control over major air pollutants shall be put in practice in the Municipality. Concentrations of pollutant emissions shall not exceed the provisions in national and municipal emission standard. Key polluters determined by the environmental protection authority shall obtain the emission license of major air pollutants. Early warning and response mechanism of heavy pollution weather shall be established.
The Regulations further stresses the importance of joint efforts by, and coordination among, all provinces and cities located in the Yangtze River Delta region in combating air pollution. In this regard, the Regulation sets forth specific actions to be taken by the Shanghai municipal government. Chapter VII includes administrative penalties with fines from RMB50,000 to RMB500,000. In addition, violators are potentially liable for daily penalties up to the amount of the original fine for continuing violation after the compliance deadline.
