Social Insurance Law.

The Social Insurance Law of the People’s Republic of China establishes the national framework for social insurance and regulates the rights and obligations of individuals, employers, and government authorities. It provides for basic pension, medical, work injury, unemployment, and maternity insurance, and sets out rules on fund collection, administration, supervision, and legal liability to ensure social protection and social stability.
The Law specifies participation requirements, financing arrangements, benefit eligibility, and fund management mechanisms for each insurance scheme. It provides for contributions by employers and individuals, government subsidies where applicable, portability of insurance rights across regions, direct settlement of certain medical expenses, and strict supervision of social insurance funds and administrative agencies.
With respect to rural residents, the Law establishes and improves the New Rural Social Pension Insurance system and the New Rural Cooperative Medical Scheme. Rural residents who meet statutory conditions may receive monthly pension benefits funded through individual contributions, collective support, and government subsidies. The Law also allows integration of rural and urban resident pension schemes and provides a legal basis for rural residents’ access to basic medical insurance and related benefits.
