Abstract
This Act consists, in its consolidated version, of 46 articles, harmonises Cyprus legislation with the Directive 98/8/EC of the European Parliament and of the Council on the placing of biocidal products on the market and provides for: granting of a license for placing on the market biocides for use within the Republic; the recognition of licences, which come from Member States; the determination of the active substances or basic substances that may be used in biocidal products. The following relevant terms are defined: authorisation; substance of concern; Competent Authority, as the Agricultural Chemicals Control Board; basic substances; biocides; limited risk biocidal product; making available on the market; active substance; harmful organisms; scientific research and development; residues; substance.
The Act covers the following matters: field of application and products not included in the Act; devolution of powers of the Agricultural Chemicals Control Board; making biocides available on the market, including: conditions for granting a license, licensing requirements, mutual recognition, ordinances, license renewal, amendment and revocation; availability of active substances on the market; application for inclusion of a new active substance; use of the data held by the Competent Authority for the benefit of other applicants; new information; provisional approval; research and development; exchange of information; classification, packaging and labelling of biocides; safety data sheets, including: identification of risks, handling and storage, toxicological data, disposal instructions; poison control; appointment and power of inspectors; offences; administrative sanctions and fines. Appendices concern: list of chemical products contained in biocidal and measures to be taken to protect humans, animals and the environment, including waste management, reuse and recycling, groundwater and surface water protection from pollution; toxicological studies and effects on productive and domestic animals, on human exposure and food and animal feed, on birds, on aquatic organism and fish species, on plant protection.
