Abstract
This Law implements provisions of the Regulation (EU) 2016/2031 of the European Parliament and of the Council on protective measures against organisms harmful to plants; and of the Regulation (EU) 2017/625 of the European Parliament and of the Council on official controls and other official activities carried out to ensure the application of food and feed Legislation and rules on animal health and welfare, plant health and plant protection products, and amending previous European Law. This Law apply to plants, plant products or others items regarding their protection from harmful organisms, and include: protection measures; official controls and other official activities carried out to ensure the health of plants and plant products; application of the protection measures of plants, plant products or other objects deriving from the International Convention for the Protection of Plants (International Plant Protection Convention, IPPC).
The Law empowers the competent authority to: take all necessary measures and actions to eliminate or prevent the spread of a harmful organism upon detection or suspicion of its presence; carry out checks on plants, plant products or other objects originating from or destined for third countries or traded from and to Member States of the European Union; issue or revoke any documents, permits, certificates or phytosanitary passports for the better implementation of the provisions of this Law and the European Regulations; update and implement Contingency Plans or Action Plans for an effective implementation of protective measures against organisms harmful to plants; determine the procedures for registering and updating the register of professionals, whose activity poses a risk for the introduction or spread of harmful organisms. The Law details powers of inspectors, and prohibits anyone from importing, exporting, placing on the market plant, plant products or other items, if there is reasonable suspicion of the presence of a harmful organism. The Law concerns administrative sanctions, offences and penalties.
