Abstract
The above-mentioned Ordinance implements the European Parliament and Council Directive 94/62/EC of 20 December 1994 on packaging and packaging waste which aims aims to harmonize national measures concerning the management of packaging and packaging waste in order, on the one hand, to prevent any impact thereof on the environment of all Member States as well as of third countries or to reduce such impact, thus providing a high level of environmental protection, and, on the other hand, to ensure the functioning of the internal market and to avoid obstacles to trade and distortion and restriction of competition within the Community. The present Ordinance covers all packaging placed on the market in Germany and all packaging waste, whether it is used or released at industrial, commercial, office, shop, service, household or any other level, regardless of the material used. At the outset the text contains a definition clause relating to various terms therein employed such as for example “packaging”, “sales packaging”, “grouped packaging”, “transport packaging”. The text consists of 17 articles divided into 4 Parts as follows: Objectif, sphere of applications, definition of terms (1); Duty of recovery and recycling (2); Production, marketing and labelling of packaging (3); Violations, transitional and final provisions (4).
