Abstract
This Order lays down Danish rules on packaging requirements and extended producer responsibility for packaging, including packaging waste and other waste collected together with packaging waste. It applies broadly to packaging placed on the Danish market, subject to exclusions for certain deposit-and-return beverage packaging, and sets requirements on packaging composition, essential design requirements, heavy-metal limits, specific rules for glass packaging, plastic crates and plastic pallets in closed controlled loops, minimum prices for certain carrier bags, documentation duties, marking and identification systems, and statistical information on packaging placed on, imported to or exported from the market. It also establishes the producer register administered by Dansk Producentansvar, requiring producers and representatives to register, report packaging quantities, distinguish household and commercial packaging, report reusable packaging and take-back schemes, and provide data used to allocate producer responsibility.
The Order further regulates the practical operation of extended producer responsibility, including allocation of municipal packaging-waste fractions to producers, municipal collection and transfer of waste, producer duties to take over or pay for collection, transport and treatment, transition rules for existing municipal contracts, take-back schemes, collective schemes, self-monitoring, reporting, fees, supervision, enforcement, and penalties. It includes rules intended to support high actual recycling, cost allocation for packaging waste collected with other waste, emergency allocation where a collective scheme ceases, and control powers for the Danish Environmental Protection Agency and other authorities. The Order implements parts of EU rules on packaging and packaging waste, single-use plastics, technical regulations and market surveillance.
