Abstract
This Order regulates reporting of waste data to Denmark’s Waste Data System, which is maintained by the Danish Environmental Protection Agency and contains information on waste generation, collection, treatment, import and export. It applies to businesses responsible for collecting, receiving, treating, pre-treating, importing or exporting waste, including registered collection undertakings, producer-responsibility actors, waste treatment facilities, biogas plants and others responsible for recovery or disposal. The Order sets annual digital reporting obligations, normally by 1 February for the previous calendar year, including data on the reporting undertaking, waste producer, recipient, waste type, quantities, EAK codes, waste fractions, treatment method and R/D recovery or disposal codes, with special rules for construction waste, sludge, imported and exported waste, and hazardous waste. It also provides exemptions from reporting for certain waste streams, rules on access to and correction of data by waste producers, municipalities and the Environmental Protection Agency, record-keeping duties for hazardous waste transporters, brokers and dealers, supervision and penalties for non-compliance. The Order implements parts of EU waste, packaging waste, WEEE, landfill and services legislation.
