Abstract
These Regulations, made under provisions of Sections 9 (1), 11 (5), 90( 2) of the Fishing Act and Section 6 (1)(1) of the Exclusive Economic Zone Act (1993), concern fishing in the sea in compliance with European Union Legislation; and establish rules concerning: fishing in inland water bodies, border water bodies, water protected areas, internal and territorial seas and the exclusive economic zone. The Regulations define: fish minimum size; hook; lure and bait; winding fishing line; standing trap. The Regulations describe: permitted fishing gears; various types of permitted fishing trap; underwater fishing gear, including harpoon and harpoon gun; snap traps, including shore net and open water net; various types of fish traps.
Chapter 3 of the Regulations concerns: requirements for marking fishing gears, and includes: requirements for marking fishing gear in the inland sea, up to four nautical miles from the baseline of the territorial sea, in internal and border waters; requirements and prohibitions related to keeping fish in the water body after fishing; marking of fishing gear more than four nautical miles from the starting line of the territorial sea and compliance with European Legislation; marking of fishing gears and their storage in the body of water for recreational fishing. Chapter 4 concerns minimum sizes of fish, bycatch conditions and methodology for determining share, and includes: determination of the share of fish species in the trawl catch, through random sampling; requirements and conditions regarding by-catch, and prohibited fish species. Chapter 5 concern: general requirements, restriction and prohibitions concerning fishing areas, and includes: requirements for the use of fishing gear and fishing methods; requirements for placing fishing gears; measurement of the mesh size of fishing gear; frequency of inspection of fishing gear; restrictions on the use of fishing gear and fishing methods; fishing bans for certain species.
Chapter 6 concerns restrictions, requirements and prohibitions related to the area of the Baltic Sea, in compliance with the Regulation (EU) of the European Parliament and of the Council no. 2019/1241, and includes: fishing bans for salmon and sea trout fishing; prohibition to catch some species in defined periods; permanent and temporary prohibition of fishing with trawl nets, depending on the location; specific requirements for fishing with traps, with strainers, gill nets and longlines. Chapter 7 concerns restriction, requirements and prohibitions related to various inland water bodies, including: fishing prohibitions in periods of time and selected areas; bycatch requirements; specific requirements for fishing with traps, with strainers, and gill nets; Ministerial power to change the prohibition period, fishing area, by-catch rate, minimum size and mesh size of fishing gear; year-round fishing prohibition times and areas; fishing bans for protecting fish species in specified lakes.
