Abstract
The Proclamation consists of 22 articles divided into 6 Parts: Preliminary (1); Control of pollution (2); Environmental standards (3); Environmental inspectors (4); Offences and penalties (5); Miscellaneous provisions (6).
Article 3 sets out general rules regarding control or prevention of pollution including use of clean technologies and the polluter pays principle. Article 4 concerns hazardous waste, chemical substances and radioactive substance. Article 5 provides for collection, transportation, treatment (including recycling) of municipal waste. The Environmental Protection Authority shall formulate “practicable” environmental standards based on scientific and environmental principles. The standards shall at least have respect to: discharge or effluent waste water and sewerage, air quality, subsoil, noise and waste management (art. 6). Environmental Inspectors shall be nominated by the Authority or the Regional Environmental Agency. Powers and duties of the Inspectors are set out in article 8. Inspectors may order remedial action in case any activity causes damage to the environment. Appeal against decisions of Inspectors may be had under article 9.
