Abstract
The present Regulation establishes detailed rules with respect to the certificate of inspection prescribed by article 11(1) (b) and (3) of Regulation 2092/91/EEC and with regard to the submission of such certificate for imports undertaken on the basis of article 11(6) of the same Regulation. However, these provisions shall not apply to those products which are not intended for free circulation within the Community in unaltered state or after processing. The release for free circulation in the Community of a consignment of products referred to in article 1 of Regulation 2092/91/EEC may take place upon: (a) submission of an original certificate of inspection to the relevant Member State’s authority, and (b) verification of the consignment by the same authority. Article 4 describes with detail the conditions under which such certificate of inspection shall be issued. On the other hand, and without prejudice to any measures taken as per article 9(9) of Regulation 2092/91/EEC, the release for free circulation in the Community of products not complying with the requirements of that Regulation shall be allowed, provided that the references to the organic production method are removed from the labels, advertisements and accompanying documents (art. 6). Two Annexes are attached. Annex I contains the model of the certificate of inspection for import of products from organic production into the Community; Annex II lays down the model of the extract of the certificate of inspection.
