Abstract
Directive 2011/83/EU on consumer rights aims to enhance consumer protection and harmonize regulations across EU member states. The Directive is structured into six chapters, comprising thirty-five articles and two annexes.
The first chapter outlines the Directive's objectives, provides definitions for key terms, and specifies the scope of its application. The second chapter focuses on consumer information and the right of withdrawal for distance and off-premises contracts. It mandates comprehensive pre-contractual information requirements and establishes consumers' rights to withdraw from contracts within a 14-day period, ensuring consumers are well-informed and have the opportunity to reconsider their decisions. In the third chapter, the Directive addresses other consumer rights specific to sales contracts. It sets forth consumers' rights regarding delivery, the passing of risk, and the handling of digital content contracts. This ensures that consumers are protected in various transactional scenarios, including those involving digital goods and services. The fourth chapter includes general provisions, such as the obligation for Member States to ensure compliance and effective enforcement of the Directive's rules. It emphasizes the need for robust implementation mechanisms to uphold consumer rights effectively. The final chapter contains provisions related to the adoption of the Directive, including its entry into force and the repeal of previous directives.
