Abstract
The present Act lays down provisions for the implementation of Regulation (EC) No. 1069/2009 of the European Parliament and of the Council and Commission Regulation (EU) No. 142/2011. The Act contains 76 sections divided into the following chapters: 1) General provisions; 2) Use of by-products and derived products; 3) Disposal of by-products and derived products; 4) Registration and approval of operators and establishments; 5) Business operation; 6) Control authorities and their tasks; 7) Supervision; 8) Laboratories; 9) Fee and charges; 10) Administrative coercive measures; 11) Special provisions; 12) Entry into force.
By-products and derived products are classified into categories 1, 2 and 3, taking into account the degree of risk they pose to human and animal health, as provided for in articles 8 and 10 of Regulation (EC) No. 1069/2009. The Act regulates matters such the use of animal by-products and derived products as feed, including fish feed; the placing on the market of unprocessed wool and animal hair; the use of animal by-products as fertilizers or raw materials for fertilizers; the use of animal by-products in bioenergy production; exceptions from Regulation (EC) No. 1069/2009 concerning the disposal of by-products; disposal of food of animal origin which is no longer intended for human consumption or feed; reporting obligation for those who dispose of by-products; reporting obligations for operators; the competence of different national authorities; the approval of laboratories; etc.
