Abstract
This Act makes provision for certain measures to prevent the spreading of pests and diseases affecting live fish in Scotland and provides a series of measures in respect of salmon and freshwater fisheries.
As for the prevention of spreading of diseases, the Act, among other things: (a) provides measures to control parasites on fish farms; (b) provides measures for the containment of fish on fish farms, prevention of escape of fish and recovery of escaped fish; (c) provides a power for the Scottish Ministers to approve a code of practice giving guidance and promoting desirable practices in respect of such measures; (d) empowers the Scottish Ministers to restrict the introduction of fish in marine waters and inland waters. In addition the Act grants powers to the Scottish Ministers to make an Order in relation to waters which the Scottish Ministers have reasonable grounds for suspecting are, or may become, infected waters and to take measures in respect of such area to prevent the spreading of Gyrodactylus salaries.
As for salmon and freshwater fishing, the Act, among other things: (a) prohibits certain fishing methods; (b) enables the Scottish Ministers to make an Order specifying a weekly close time for freshwater fish; and (c) enables the Scottish Ministers to make Regulations for the conservation of freshwater fish.
The Act also provides British sea-fishery officers with the power to issue a fixed penalty notice to a person whom the officer has reasonable grounds for suspecting to have committed a an offence specified by the Scottish Ministers by Order and contains other provisions relative to sea fisheries offences.
