Abstract
This Act creates Historic Environment Scotland, which will be a Non-Departmental Public Body. It will be the lead agency for management and administration of Scotland‘s historic environment. The Act also sets out the governance arrangements for the new body and provides for the delegation or transfer to Historic Environment Scotland of Ministerial powers and responsibilities under existing legislation. Historic Scotland has no powers of its own, but operates using powers conferred on Scottish Ministers. Its main function is to designate and manage places to be protected. The Act also provides with respect to powers of Historic Environment Scotland to enter land and to issue enforcement notices.
