Abstract
The 76 sections of this Act are divided into 5 Parts: Internal Drainage Boards (I); Provisions for facilitating or securing the drainage of land (II); Powers to modify existing obligations (III); Financial provisions (IV); Miscellaneous and supplemental (V).
Internal Drainage Districts and Internal Drainage Boards, established by the 1976 Act, shall continue their existence under the present Act. Districts and Boards may be created, amalgamated, abolished or reorganized on the basis of schemes to be submitted by the National Rivers Authority (the "NRA") to the relevant Minister for confirmation (sect. 3). Powers, duties, liabilities and obligations of Boards may be transferred to the NRA (sect. 4). Drainage Boards may be supervised by the NRA (sect. 7). The NRA may also enter into agreements with Boards for the purpose of waterworks on main rivers which the NRA is authorized to carry out (sect. 11). Sections 12 and 13 provide for duties authorities with respect to environment protection. Part II provides for powers of the NRA, the Minister, the Boards, and county councils with respect to drainage and the prevention of floods. Each of the Ministers specified in section 72 shall have the power to make regulations for the purpose of: (a) prescribing anything which may be prescribed under this Act or; (b) generally carrying into effect of this Act (sect. 65). Powers of local authorities and Internal Drainage Boards to acquire and dispose of land are set out in section 62. The Act is completed by 6 Schedules.
