Resolution No. 423 of 2013 of Georgian Government on Fishing and on Protection of Fish Stock

This Resolution approves the technical regulation on fishing and on the protection of fish stock. The regulation consists of 30 articles: Scope of technical regulation (1); Definition of main concepts (2); Scope of application (3); Seasons and area of prohibited fishing (4); Prohibited species for fishing (5); Certain gear, devices and methods that are prohibited in fishing (6); Other prohibitions in fishing and protection of fish stock (7); Size of fishing net mesh in fishing gear (8); Minimum size for fish that may be caught (9); Maximum amount of bycatch with the minimum size fish (10); Maximum amount of bycatch with other species of fish (11); Rules for placing fishing equipment in water object and construction of a fish breeding structure (12); Amateur and sport fishing (13); Fish protection measures by water-capturing facilities (14); Special requirements imposed on fishing (15); Electronic monitoring system (15-1); Fishing for scientific-research purposes (16); General requirements imposed on Georgian vessels involved in fishing and fishing-related activities in a territorial sea and EEZ of a foreign country, as well as in the high seas (16-1); Inspection of foreign vessels in Georgian harbours (16-2); Authorization of foreign vessels to enter a Georgian harbour (16-3); Import of fishery products (16-4); Export and re-export of fishery products (16-5); Authorization of Georgian vessels involved in fishing and fishing-related activities in a territorial sea and EEZ of a foreign country, as well as in the high seas (16-6); Authorization in case a vessel changes its flag state (16-7); Review of the authorization application (16-8); Requirements imposed on vessels involved in fishing and fishing-related activities in a territorial sea and EEZ of a foreign country, as well as in the high seas (16-9); Notifying the flag state and international cooperation (16-10); Requirements imposed on Georgian citizens and legal entities registered in Georgia (16-11); Liability for violation of this technical regulation (17); and Amendments and additions to the technical regulations (18). The technical regulation also contains the following annexes: Annex 1 Fishing gear and mesh size; Annex 2 minimum size of fish species allowed to be caught; Annex 3 fishing log; Annex 4 Technical properties and terms of use of the electronic monitoring system; Annex 5 - List of products excluded from the definition of fishery products set out in point 4 of Article 16-4; Annex 6 Application form provided for in point 8 of Article 16-4; Annex 7 - Form for prior notification; Annex 8 - Simplified prior notification form; Annex 9 - Form for pre-landing declarations; Annex 10 - Form for pre-transshipment declaration; Annex 11 Catch certificate, Re-export certificate; Annex 12 - Catch certificate - Simplified Form for fishery products fulfilling the requirements in Article 6 of Regulation of 22 October 2009 (EC) No 1010/2009, Re-export certificate; and Annex 13 Technical properties and terms of use of the satellite electronic monitoring system.
