Law no. 5069 of 2023. Conditions of building, construction, permitted land uses for data centres, zoning and urban planning regulations, utilisation of Green Fund resources, other environmental and energy provisions and other urgent provisions.

This Law, consisting of 68 articles, defines a framework for: updating data centres operations; dealing with urban planning and spatial planning issues; strengthening powers of agencies and bodies involved in environmental protection; implementing targeted measures for the development of renewable energy sources.
The Law concerns the following matters: determination of permitted uses, authorising provisions, required operations, and land uses concerning data centres; conditions for building data centres; spatial and urban planning provisions, including: property utilisation in defined areas; expropriation of property; land registry use and electronic registration; amendment of existing zoning Plans; management and utilisations of ports and port areas; determination of land uses, and construction conditions and restrictions within the land zone of the port; strategic environmental assessment for port activity and operations; preparation of specific Plans concerning port areas utilisation and management; measures for specifying spacing distances for the installation of photovoltaic stations; urban planning measures, introduction of environmental levy and related exemptions; definitions of a method for calculating land tax on properties; certification for the urban development of the areas of environmental upgrading; preservation of the adequacy of land in special cases on forced expropriation; parking provisions.
Concerning measures for environmental protection, this Law provides for: necessary flood protection and infrastructure restoration works; preparation and implementation of a local waste management Plan and role of the public authorities of certain municipalities; specific procedures for the use of the resources of the Green Fund; incentives and compensation for forest workers; financing procedures for implementing actions and projects of the Ministry of Environment and Energy; drawing up an Action Plan for the management of protected areas; content and revision process of the national Strategy for biodiversity; projects and activities not subject to environmental licensing; measures for the prevention and remediation of waste pollution; measures for members of the energy and wastewater regulatory Authority; measures for improving forest fire fighting; regulating logging operations for the installation of photovoltaic plants; measures and incentives for increasing energy efficiency in urban planning, public buildings, infrastructure and public facilities.
