Abstract
This Law, consisting of 92 articles divided into twelve Chapters, approves the Mining and Quarrying Code regulating the exploration, exploitation and commercialization of mineral products extracted in the soil, subsoil and waters under the jurisdiction of the Republic of Guinea-Bissau. The Act does not apply to liquid and gaseous hydrocarbons, and lays down the regimes applicable to mining titles, mining undertakings, mines, authorizations, quarries, marketing and processing of mining products, rights and obligations. It specifies the following mining titles to be obtained: a) Authorization of prospection; b) Research licensing; c) Small mining licence; d) Large mining licence; e) Inert research authorization; f) Industrial quarry licence; g) Purchase/sale/transformation licensing of mineral products. Mining agreement, taxes, customs, offences and penalty regime are specified in the text. The Law is divided as follows: Mining Titles (Chap. II); Mining Companies (Chap. III); Mines (Chap. IV); Authorization to Retain Licence (Chap. V); Quarries (Chap. VI); Commercialization and Transformation of Mining Products (Chap. VII); Rights and Duties (Chap. VIII); Mining Agreement (Chap. IX); Fiscal and Customs Regime (Chap. X); Sanctions, Offences and Penalties (Chap. XI); Final and Transitional Provisions (Chap. XII).
