Abstract
With the aim of protecting people's health from the negative effects of any pollution of water intended for human consumption by ensuring its healthiness and purity, this Law regulates the healthiness of water intended for human consumption (water quality), competent bodies and the tasks of competent bodies, official laboratories and the method of authorization of official laboratories, parameters of conformity of water intended for human consumption, implementation of water safety approaches based on risk assessment and risk management, rights and obligations of water suppliers and other entities, minimum hygiene requirements for materials that come into contact with water intended for human consumption human consumption, minimum requirements for processing chemicals and filtering media that come into contact with water intended for human consumption, the method of implementation of monitoring, their financing and the method of reporting to the European Commission, the methods of handling and reporting in case of deviations from the parameters for checking the conformity of water intended for human consumption, deviations, the method of informing and notifying the population, the method of implementing official health controls of water intended for human consumption and their financing, and prescribe administrative measures and misdemeanor provisions for the implementation of the provisions of this Law, the way of implementing official controls on the healthiness of water intended for human consumption and their financing, and administrative measures and misdemeanor provisions are prescribed for the implementation of the provisions of this Law, the way of implementing official controls on the healthiness of water intended for human consumption and their financing, and administrative measures and misdemeanor provisions are prescribed for the implementation of the provisions of this Law.
This Law further regulates the requirements for protecting the health of the population from radioactive substances in water intended for human consumption, as well as parameter values, frequency and methods for monitoring radioactive substances in water intended for human consumption. With this Law, certain acts of the European Union are adopted into the Croatian legislation (see article 2). The provisions of this Act apply to all water regardless of its origin in its natural (original) state or after processing, including desalination procedures, if it is used as water intended for human consumption, regardless of whether it is used as cold or hot water or for the purpose of production, processing, preservation and distribution of food, regardless of whether it is delivered from the water supply network or in a tank or in water carriers or is placed in bottles or packaging.
The provisions of this Law shall apply to all water used in the food business for the production, processing, preservation or placing on the market of products or substances intended for human consumption. The provisions of this Law apply to all water producers, importers and distributors who place water intended for human consumption on the market of the Republic of Croatia. The provisions of this Law also apply to the production, placing on the market and installation and use of construction products, objects and materials that come into contact with water intended for human consumption, and also will apply to the use of processing chemicals and filtering media that come into contact with water intended for human consumption. The provisions of this Law are also applied to the construction of buildings in which water intended for human consumption is used and to the health testing of water intended for human consumption in buildings. The provisions of this Law and the regulations (as defined in article 9, paragraph 1, subparagraph 1 of this text), which regulate the parameters of conformity of water intended for human consumption, will be applied also to table and spring waters that are put into bottles or packaging, unless otherwise stated. prescribed by the regulation governing table and spring waters. The provisions of this text further apply to small water suppliers. The provisions of this Law apply to maritime vessels on which commercial activity is carried out, and which desalinate water for the purposes of that activity, and to vessels that transport passengers and to ships that act as water suppliers, including water carriers. The provisions of this Law also apply to water intended for human consumption that is used as input water for filling swimming pools, fountain water and thermo-mineral water used for drinking. The provisions of this Law also apply to ice that is obtained from water intended for human consumption and which must meet the values of the conformity parameters.
This text is divided into fifteen main thematic Chapters and a total of 90 articles. Titles of these Chapters are as follows: I. General provisions; II. Competent authorities; III. Laboratories for water intended for human consumption: official, internal laboratories of water suppliers and laboratories of food business entities; IV. Quality standards/points of compliance; V. Risk-based approach to water safety; VI. Rights and obligations of suppliers of water intended for human consumption and other entities; VII. Minimum hygienic requirements for materials, processing chemicals and filtering; VIII. Monitoring; IX. Financing of state monitoring, official controls and other obligations; X. Procedure in case of deviation from the parameters for verifying the compliance of water intended for human consumption; XI. Access to water intended for human consumption; XII. Informing and notifying the population; XIII. Official controls; XIV. Offensive provisions; and XV. Transitional and final provisions.
