Regulation on the investigation of maritime incidents.

This Regulation lays down the conditions, procedures, manner and authorization for conducting investigations on maritime accidents and incidents, so as to: a) enable expedient conducting of safety investigations and appropriate analysis of maritime accidents and incidents; b) secure timely and exact reporting of investigation results and proposals to improve the state of affairs; c) define the procedure when conducting administrative investigations, with the purpose of improving the safety of navigation and reducing the risk of future maritime accidents.
This Regulation applies to maritime accidents, incidents and alarms due to peril in which maritime vessels of Croatian nationality or those which have originated within a region in which the Republic of Croatia has its sovereignty or which includes other significant interests of the Republic of Croatia, participate. In the event of loss of human life, vessels which are not obliged to be entered into registries and logbooks shall be considered maritime vessels.
The basic facts of the maritime accident are: what, when, where and how the accident occurred.
Further investigations are done in order to determine and state where any person is killed or injured, whether there was any damage to the ship, cargo or environmental pollution as a consequence of the accident.
This Regulation shall not apply to maritime accidents, incidents and alarms due to peril in which only war ships are involved, and when the maritime accidents and incidents are the consequence of actions or intentions to inflict damage to a maritime vessel or marine environment ( terrorism, piracy, etc).
The Annex is an integral part of this Regulation.
