Abstract
The purpose of this Act to raise funds for the prevention and reduction of environmental hazards and damages caused by products which directly or indirectly endanger the environment or one of its elements during the production, marketing, utilisation of the product, as well as to contribute to the prevention and reduction of environmental pollution and to the promotion of activities oriented towards the sustainable management of natural resources. Products subject to environmental protection fee are batteries, Packaging materials, petroleum products, electric and electronic equipments, rubber tires, paper-based advertising materials.
The Act is divided into ten chapters. Chapter I provides for general rules on the payment of the charge. Chapter II sets forth rules regarding the execution of the obligation to pay the fee. It contains provisions regarding the obligation of reporting, registration, accounting, etc. Chapter III lays down special rule regarding the obligation of payment of the fee. Chapter IV rules the organisation of waste management of products subject to the environmental protection fee. It sets up the Product Fee Board and the National Waste Management Agency. Chapter V provides for registration and data management. Chapter VI rules the refund of the fee. Chapter VII contains special rules regarding certain products (rubber tires, packaging) subject to the payment of the environmental protection fee. Chapter VIII provides measures of controlling. Chapter IX contains rules regarding sanctions (penalties, confiscation). Chapter X lays down the final provisions. Annex 1 to this Act contains the complete list of products and materials which are subject to the payment of the environmental protection fee. Annex 2 determines the amounts of the environmental protection fee for certain products and materials.
