Abstract
This Act consists of nine parts which regulate in detail the following issues: the protection of trademarks (Part I); the procedures before the Hungarian Patent Office in trademark matters (Part II); the Community trademark system (Part III); the international cataloguing of trademarks (Part IV); court proceedings in trademark cases (Part VI; collective marks and certification marks (Part VI); the protection of geographical origin (Part VII); Community protection of certain geographical indications and international cataloguing of designations of origin (Part VIII); final provisions (Part IX).
Additionally, the Act delineates the specific legal criteria required for trademark eligibility, outlining absolute and relative grounds for refusal, while defining the explicit rights and limitations conferred upon trademark owners. It establishes rigorous enforcement mechanisms to combat trademark infringement, providing intellectual property holders with clear civil remedies—including injunctions, damages, and the seizure of counterfeit goods—to protect their commercial identity in the marketplace.
The Act also integrates Hungary's national industrial property system with European Union and international standards. Furthermore, the Act regulates the administrative maintenance of these intellectual property records, ensuring that the national trademark and geographical indication registers function as fully modernized, authentic public databases to guarantee legal certainty and transparency for businesses.
