Abstract
This Decree, in accordance with Law No. LVII of 1995 on water, regulates the constitution, closure, organization, management and operation of water management companies. It also determines, among others, rights and obligations of members, and provides for the protection of interest of companies supplying potable water and sewerage services. One company per area is allowed to perform this public service (Article 1). Articles 2-6 cover the constitution of such companies by an organizing committee, which is established for the preparation of the constitution of water management companies. The structure and operation of these companies are determined in Articles 7-11. The main organ is the general assembly or the delegates' meeting to be determined in the constitution. The executive committee implements the decisions of the meeting and takes decisions on questions of its competence. The Decree provides for a controlling commission as well, elected for not more than five years. The managing director should be selected by competition. Rights and obligations of members are provided for in Article 12. Articles 13-14 deal with financial rules of operation. Closure of the company, by merger or demerger, is ruled in Articles 15-16. Special provisions regarding the closure of water supplying and sewerage companies are laid down in Articles 17-22. Article 23 deals with the protection of the interests of companies. Contributions for public purposes are regulated in Articles 24 and 25.
