Decree No. 21 of 2012 (III. 9.) VM of the Ministry of Rural Development regarding certain questions related to the payment of damage mitigation contribution and to the compensation for damages.

The beneficiaries of the compensation are agricultural producers who contribute to the agricultural weather risk management scheme. Contribution is compulsory above a certain size of cultivated land (1 to 10 hectares depending on the type of cultivation). The agricultural producers’ annual contribution is calculated on the basis of their application for EU direct payments. The resources of the mitigation scheme will derive from: annual producers’ contributions from producers participating in the risk management scheme; annual budgetary allocations from the State amounting to at least the total producer contributions during the previous year; unused funds from the two above sources in the previous years; additional ad hoc grants from the State budget. The Damage Verifying Body through the issuing of an official certificate in line with the provisions of this Decree certifies the loss of agricultural producers. Institutions involved in the identification and certification of adverse climatic events and natural disasters are defined in this Decree too. Each natural disaster or adverse climatic event will be recognised and certified by the public authorities according to the procedure described in this Decree.
