Abstract
This Government Regulation, consisting of 298 articles, implements the provision of articles 28 and 185 letter b, of the Act no. 11 of 2020 regarding job creation, and aims at organising and implementing maritime affairs and fisheries, by defining: changes in the status of the core zone in the region conservation; criteria and requirements for establishment, placement and demolition of buildings and installation at sea; management of fish resources; fishery products quality standards; fish farming and fishing not for commercial purposes; fishing vessels and fishing port management; control on import of fishery and salt commodities. The following relevant terms are defined: sea, small islands, fisheries, small fish cultivators, public consultation, zoning plans for strategic areas and for coastal zones, conservation area, core zone, marine resources, customary law community, local community, traditional society, fishing vessel, fishing port, potential fish cultivation land, fish disease outbreak, fishery products, fish handling, fish processing, nutrients, traceability, high seas, fishery company, operational safety of fishing vessels, salt, salt farmers, salt commodities, land waters, aquaculture-based fishing.
Concerning core zone status changes, the Regulation defines Ministerial powers and the categories of changes. Concerning building installations at sea, the Regulation specifies criteria for defining: types of buildings and related functions; establishment and placement requirements, including protection and preservation of marine resources; demolition and installation of buildings; coordination, monitoring and evaluation. The Regulation concerns management of fish resources and defines: State fisheries management area, including sustainable management of fish resources and prevention of pollution and damages to fish resources and the environment; fishing vessel monitoring system; aquaculture and new types of fish to be cultivated and stocked, and the redistribution area; fish disease outbreaks, procedures for their determination and management and control.
Concerning quality standards of fishery products, the Regulation provides for duties of business actors involved in fish business, standard of raw materials, hygienic standards, packaging and labelling techniques, handling and storage techniques, traceability system and development of quality standards. The Regulation concerns dispositions on fishing activities intended not for commercial purposes, including: education, research, scientific activities, fun and travel. Different types and models of fish ships are defined, considering their functions and use; different roles and responsibilities of crew are established, including marine employing agreement and social service. The Regulation concerns provisions on fisheries port and defines the fish port order, the fishing port facilities, planning and construction and all the activities related to port management and its development, including: search and rescue assistance, pollution control, general protection of marine environment, inspection of captured fishes. The Minister is empowered to control fisheries and issue commodity and salt import approval.
