Abstract
These Regulations give effect to Council Directive 92/43/EEC on the conservation of natural habitats and of wild fauna and flora. The Regulations empower the Minister to designate special areas of conservation (endangered species and habitats of endangered species) as a contribution to the European network of special areas of conservation and special protection areas under Council Directive No. 79/409/EEC ("the Birds Directive"). The Regulations also place an obligation on the Minister, other Ministers of the Government, Local Authorities and other State Bodies to have regard to the provisions of the Regulations in carrying out their powers and functions under certain Enactments under their control.
The 39 regulations are divided into 5 Parts: Preliminary and general (I); Conservation of natural habitats and habitats of species (II); Protection of flora and fauna (III); Planning and development matters (IV); Miscellaneous (V).
Part III concerns the application of provisions of the Wildlife Act, 1976 to First Schedule.
