Abstract
This Notification of the Government of India is issued in accordance with the Environment (Protection) Act, 1986 (29 0f 1986) with a with a view to conserve and protect the unique environment of coastal stretches and marine areas, besides livelihood security to the fisher communities and other local communities in the coastal areas and to promote sustainable development.
The Central Government declares the coastal stretches of the country and the water area up to its territorial water limit, excluding the islands of Andaman and Nicobar and Lakshadweep and the marine areas surrounding these islands, as Coastal Regulation Zone (CRZ). For the purpose of conserving and protecting the coastal areas and marine waters, the CRZ area shall be classified as: 1. CRZ-I areas ( environmentally most critical); 2. CRZ-II which shall constitute the developed land areas up to or close to the shoreline, within the existing municipal limits or in other existing legally designated urban areas; 3. CRZ-III including land areas that are relatively undisturbed and those which do not fall under CRZ-II; 4. CRZ- IV which constitutes the water areas.
Section 4 provides for the prohibited activities within CRZ, including: (i) Setting up of new industries and expansion of existing industries, operations or processes. (ii) Manufacture or handling of oil, storage or disposal of hazardous substance; (iii) Setting up of new fish processing units; (iv) Land reclamation, bunding or disturbing the natural course of seawater except for the activities permissible; (v) Discharge of untreated waste and effluents; etc. The Notification further sets up rules for permissible activities in CRZ, Coastal Zone Management Plan development and approval, CRZ clearance for permissible and regulated activities, etc.
