Abstract
These Rules are made in exercise of the powers conferred by sections 6, 8 and 25 of the Environment (Protection) Act, 1986 (29 of 1986) read with sub-rule (3) of rule 5 of the Environment (Protection) Rules, 1986, and in supersession of the E-waste (Management) Rules, 2016.
Chapter I contains the short title, date of commencement, scope of the Rules and definitions. Chapter II provides for the Extended Producer Responsibility Framework which requires registration of manufacturers, producers, refurbishers and recyclers. It prohibits registers entities to deal with the unregistered ones. Chapter III lays down the responsibilities of manufacturers, producers, refurbishers, bulk consumers, recyclers and state governments. Chapter IV provides for the procedure for storage of e-waste and chapter V provides for management of solar photo-voltaic modules, panels and cells. Chapter VI makes provisions in respect of modalities of Extended producer responsibility regime, and certifications for recycling and refurbishing. Chapter VII requires producers to reduce the use of hazardous substances in manufacture of electronic equipment and components. Chapter VIII provides for appeals, compensation, and formation of Steering Committee.
