Abstract
The establishment of nurseries, factories engaged either in horticulture or in the preparation and selection of seeds or in the trading of plants and seeds is subject to the issue of an authorization by the Prefect of the Province, upon approval of the Committee for the protection against plant diseases. The Ministry of Agriculture and Forestry may provide for periodical inspections of said nurseries and factories. The personnel appointed for this purpose may order the disinfection or the destruction of the products affected by a disease. In case of destruction no compensation shall be payable. Further provisions concern the import and transit of plants, parts thereof and seeds. With a view to avoid the spreading of a plant disease the landowners or lessees may constitute voluntary, municipal or provincial consortia either temporary or permanent. If necessary, and upon favourable advice of the Committee for the protection against plant diseases, the Ministry of Agriculture and forestry may impose the implementation of measures against plant diseases or the constitution of said consortia. The latter shall organize and implement the necessary protection measures and supervise their correct execution. Specific provisions are made with respect to vine pest and locusts: they concern mainly the compulsory constitution of consortia and the financing of the necessary measures by the Government.
