Abstract
In implementation of Community legislation, the present Legislative Decree makes rules on the classification, packaging and labelling of preparations destined to be placed on the market which contain at least one of the dangerous substances defined by article 2 of Legislative Decree No. 52 of 3 February 1997 and which have been classified as dangerous upon specific assessment as per articles 4 to 6 hereto. The Legislative Decree shall apply also to the classification, packaging and labelling safety data sheet regarding plant protection products as well as biocids. The products listed out in paragraph 5 of article 1 shall not fall within the application scope. Articles 3 to 6 concern the assessment procedure intended to determine whether certain preparations are dangerous or not. In particular, article 5 deals with the assessment of possible hazards to human health, whereas article 6 refers to hazards to the environment. The preparations referred to in article 1 may be placed on the market only if they comply with the requirements established under articles 8 and 9 relative to packaging and labelling respectively. The person responsible for placing on the market a preparation within the meaning of article 1 shall provide a safety data sheet (art. 13). The Higher Health Institute is designated to be the body responsible for receiving information, including chemical composition, relating to preparations placed on the market and considered dangerous on the basis of their health effects or on the basis of their physico-chemical effects (art. 15). Article 18 lays down penalties.
