Abstract
This Regional Act regulates the improvement and protection of fish population as well as fishing in internal waters of Lombardia Region, without any prejudice to the provisions laid down in the Agreement between the Federation of Switzerland and the Republic of Italy regarding fishing in Italo-Swiss waters, signed on 19 march 1986. The Regional Act is divided into five Titles.
Title I defines the aims pursued by this Regional Act, which are, among others: a) the protection of the local fish population; b) the conservation of the biological and environmental balance; c) the promotion of research and development, and aquaculture intended for the improvement of fish population. Article 2 regulates the functions of the Regional Authority, which shall formulate directives and coordinate the activities to be carried out. Further provisions regulate the functions of the Provinces concerning, among others, aquaculture concessions. Article 5 provides for the establishment of the Regional Fishery Council and the Provincial Fishery Council, which shall formulate recommendations. Article 6 provides for the recognition of fishermen's associations. Title II is related to the organization and management of fish population. Further provisions regard classification of waters. Title III regards regional aid schemes as well as fishing licences. Title IV lays down provisions concerning equipment and substances that are forbidden and other prohibitions. Article 18 concerns penalties.
