Abstract
The present Regional Act lays down the main principles governing the gathering and the placing on the market of mushrooms, in compliance with the legislative framework set out in Act No. 352 of 23 August 1993. As provided for in article 1 of this Act, the Region shall adopt a regulation to lay down further provisions implementing those hereby established. Paragraph 2 of article 1 contains the principles that such regulation must comply with, including the following: (a) the administrative functions shall be exercised by the Provinces, the Mountain Communities and the Communes; (b) the regional authority shall determine the areas falling within mountain territories in which gathering shall be allowed exclusively to residents holding a special temporary permit; (c) the total allowable catch per day amounts to 3 kg per person; (d) the regional authority is empowered to establish permanent or temporary prohibitions for ecosystem safeguarding or sanitary purposes. In addition, the following organisms and institutions shall be established: (a) the Regional Scientific Commission for Micology; (b) Micological Inspectorates. As referred to in article 2, the marketing of fresh and conserved mushrooms is subject to Presidential Decree No. 376 of 1995 and subsequent amendments. The Regional Council, on the other hand, may supplement the list of protected species contained in Annex I to the mentioned Presidential Decree and add further edible species.
