Abstract
Pursuant to the legislative framework laid down in Act No. 352 of 23 August 1993, these provisions regulate the gathering and the placing on the market of spontaneous mushrooms. The Toscana Region promotes the protection and conservation of spontaneous mushrooms. The initiatives shall be undertaken by taking into particular account the role of Mountain Communities. The Act consists of five Titles. Title II is devoted to the gathering of mushrooms, for which a special authorization is required (art. 2). Articles 3 and 4 regard gathering in protected areas and mountain territories respectively. Article 8 specifies the fees to be paid to obtain the authorization. Article 9 defines the methods and gear which shall be allowed. Article 13 specifies the areas where gathering shall not be permitted as well as the minimum sizes under which certain species of mushrooms shall not be collected. Title III deals with the marketing of mushrooms and lays down particular conditions referring to labelling and packaging. Article 19 defines the functions to be exercised by Mycological Inspectorates. The authorization referred to in article 21 is compulsory to place on the market spontaneous mushrooms. Title IV deals with inspection. Article 24 regulates the procedure to be followed for the application of the penalties established under article 25.
