Endangered Species (Protection, Conservation and Regulation of Trade) Act.

This Act provides for compliance of Jamaica with the Convention on International Trade in Endangered Species of Wild Fauna and Flora (C.I.T.E.S) of 1973, and to otherwise further protection, conservation and management of endangered species by regulating the importation and exportation of such species.
Section 4 provides for the relationship between the present Act and other legislation, notably the Wild Life Protection Act and the Customs Act. Section 5 further defines the application sphere of this Act. The Minister may, under section 13, designate a public body as Management Authority for purposes of this Act. Section 13 provides also for the establishment of a Scientific Authority . Functions of the Management Authority are outlined in section 15. The Management Authority may approve, by order, management programmes for the protection of wild fauna or flora (sect. 7). Section 10 defines breeding in captivity , whereas section 11 defines artificial propagation . Sections 16 and 17 prescribe the duties of the Scientific Authority as advisory organ to the Management Authority. Sections 19 to 43 provide for the regulation of trade in species specified in the First, Second, Third and Fourth Schedule. Trading permits shall be obtained form the Management Authority. Species listed in the First Schedule may be exported or imported under conditions listed in section 20 and 21 respectively. Section 22 provides for re-exportation of such species. Sections 24 to 27 concern international trade in species listed in the Second Schedule, sections 28 to 30 for trade in species listed in the Third Schedule, whereas section 31 provides for artificially bred species listed in the Fourth Schedule. Sections 32 to 37 provide for suspension and revocation of permits or certificates. The Management Authority shall keep registers that shall contain particulars, as may be described (sect. 38). Remaining provisions (sects. 40 to 54) deal with enforcement by authorized officers, offences, and penalties, regulation making powers of the Minister, marking of specimens, and other matters of miscellaneous nature.
